This Privacy Notice for California Residents (the “Notice”) supplements the information contained in the BalanceWise Ltd Privacy Policy and applies solely to customers, visitors, and users who reside in the State of California (“consumers” or “you”). We adopt this Notice to comply with the California Privacy Rights Act (CPRA) (collectively with any implementing regulations, the “CPRA”). Any terms defined in the CPRA have the same meaning when used in this Notice.

1. Your Rights and Choices

The CPRA provides California consumers with specific rights regarding their personal information. This section describes your CPRA rights and explains how to exercise them.

1.1 Right to Know/Access

You have the right to request that we disclose certain information about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose:

  • The categories of personal information we collected about you.
  • The categories of sources from which the personal information was collected.
  • Our business or commercial purposes for collecting, selling, or sharing that personal information.
  • The categories of third parties with whom we disclose, sell, or share that personal information.

1.2 Right to Request Deletion

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers and contractors to delete) your personal information unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service providers/contractors to:

  • Help ensure security and integrity (including detecting, preventing, and investigating incidents that compromise data security);

  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.);
  • Engage in public or peer-reviewed scientific, historical, or statistical research (if your personal information is vital to the research and you previously provided informed consent);
  • Enable internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
  • Comply with a legal obligation.

1.3 Right to Correct Inaccurate Personal Information

You have the right to request that we correct any inaccurate personal information we hold about you, taking into account the nature of the information and the purposes of its processing.

1.4 Right to Limit Use and Disclosure of Sensitive Personal Information

You have the right to direct us to limit the use of your sensitive personal information (as defined by the CPRA) to that use which is reasonably necessary for providing the services or goods you request, ensuring security and integrity, or for short-term, transient uses consistent with the CPRA. 1.5 Right to Opt Out of Sale or Sharing of Personal Information

California consumers have the right to opt out of the sale or sharing (as defined by the CPRA) of their personal information. While BalanceWise Ltd does not sell personal information in exchange for monetary compensation, we may disclose or share certain information for interest-based advertising or other commercial purposes that could be considered a “sale” or “sharing” under the CPRA. 1.6 Right to Non-Retaliation (No Discrimination)

We will not discriminate against you for exercising any of your rights under the CPRA. Unless permitted by the CPRA, if you exercise any of your California privacy rights, we will not:

  • Deny you goods or services;
  • Charge you different prices or rates for goods or services;
  • Provide you a different level or quality of goods or services;
  • Suggest that you may receive a different price, rate, or level of service.

2. How to Exercise Your Rights

2.1 Submitting Requests to Know or Delete

To exercise your rights to know (access) or delete your personal information, please submit a verifiable consumer request by any of the following methods:

Only you, or an authorised agent registered with the California Secretary of State, may make a verifiable consumer request on your behalf. You may also make a verifiable consumer request on behalf of your minor child.

2.2 Verification Process

We must verify your identity or authority to access or delete personal information. Please provide:

  • Sufficient information that allows us to reasonably verify you are the consumer about whom we collected personal information (e.g., name, email address, order details).
  • A description of your request with sufficient detail to allow us to understand, evaluate, and respond to it.

We cannot respond if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

2.3 Response Timing

We will confirm receipt of your verifiable consumer request within 10 business days and provide information about our verification process and timeframe for response.

We endeavour to respond to a verifiable consumer request within 45 days of receipt. If we require more time (up to 90 days), we will inform you of the extension and the reasons for the delay in writing.

Our response will cover the 12-month period preceding the verifiable request’s receipt. We do not charge a fee to process or respond to your request unless it is excessive, repetitive, or manifestly unfounded.

3. Information We Collect from California Consumers

We collect personal information that identifies, relates to, describes, or could reasonably be linked with a particular consumer or household. Personal information does not include publicly available, anonymised, or aggregated data.

3.1 Sources of Personal Information

We obtain the categories of personal information listed above from the following sources:

  • Directly from You – e.g., forms you complete, orders you place, or information you provide when contacting us.
  • Indirectly from Activity on Our Website – e.g., usage details collected through cookies or other tracking technologies.

3.2 Use of Personal Information

We may use or disclose personal information for one or more of the following business purposes:

  • To fulfil or meet the reason for which you provided the information (e.g., processing an order).
  • To provide products or services you request, or to respond to your enquiries.
  • To send you notices about product updates, events, or other marketing communications.
  • To carry out our obligations and enforce our rights arising from any contracts with you.

In the preceding 12 months, BalanceWise Ltd has not sold personal information in exchange for monetary consideration. We do not knowingly sell or share the personal information of consumers under the age of 16 without affirmative authorisation.

4. Additional California Disclosures

4.1 California “Shine the Light” Law

Under California Civil Code §§ 1798.83-1798.84, California residents may request a notice identifying the categories of personal information we share with third parties (or affiliates) for direct marketing purposes, and the contact information for those third parties. 4.2 Do Not Track Signals and Third-Party Tracking

Some browsers include a “Do Not Track” (DNT) feature. We currently recognise and process such DNT signals in users’ web browsers where feasible. We do allow third parties to collect usage information through cookies or other technologies on our Website for analytics and interest-based advertising, as described in our [Cookie Policy].

4.4 California Proposition 65

Under California’s Proposition 65, businesses must provide warnings to California residents about products that may contain chemicals known to cause cancer or reproductive harm. Our products (e.g., garments with zippers, handbags, footwear, or accessories) may occasionally contain such chemicals in trace amounts. We provide the following warning to California customers:
